Attorneys for the Republican-led Fairness and Accountability in Redistricting, or FAIR, wanted the justices to suspend the commissions map and to instead direct the state to modify existing districts crafted a decade ago or to draw new lines for this years races.

Political consultant David Gilliard of the FAIR group compared the decision to the bitter fight 30 years ago in which the Supreme Court narrowly upheld Democrat-crafted boundaries. Republican critics of the commissions Senate plan lashed out at Fridays decision. State Sen. Mimi Walters, R-Laguna Niguel, called the decision short-sighted and disrespectful of voters who had signed petitions to overturn the Senate maps.

In its ruling Friday, the court said there was sufficient probability that the referendum will qualify but avoided setting a specific likely to qualify benchmark. Justices instead focused on what maps should be in effect for 2012.
After reviewing the pros and cons of each of these proposed alternatives in light of the constitutional scheme and criteria, we conclude that the Commissions certified map is clearly the most appropriate map to be used in the 2012 state Senate elections even if the proposed referendum qualifies for the ballot, the unanimous court ruling read.

Democrats are widely expected to pick up the redrawn 17th along the Central Coast. Besides the 31st, two other districts are viewed as potential Democratic gains this year: the 5th, centered on San Joaquin County, and the 27th, in Ventura and Los Angeles counties.
Democrats are within two seats of achieving a two-thirds Senate majority that would let them bypass Republicans on every issue, including legislation to increase taxes.
